Introduction

CollectAPhone provides an online vehicle for consumers within the United States to recycle cell phones, smartphones and PDAs and to choose a 501c3 organization to benefit financially from their action. We reserve the right to amend, cancel or alter these services at our sole discretion.

THE USE OF THIS SITE IS GOVERNED BY THE POLICIES, TERMS AND CONDITIONS SET FORTH BELOW IN THIS USER AGREEMENT ("AGREEMENT"). PLEASE READ THIS AGREEMENT CAREFULLY. YOUR REGISTRATION, YOUR USE OF THIS SITE AND YOUR PRINTING AND/OR USE OF OUR PREPAID SHIPPING LABELS INDICATES YOUR ACCEPTANCE OF THESE POLICIES, TERMS AND CONDITIONS.

CollectAPhone is a company located in New York State. Any and all transactions conducted on this site are the sole responsibility of CollectAPhone. The following terms and conditions apply to your use of the CollectAPhone website and its programs. If you have any questions that our Help page cannot answer, please contact us. We may amend these terms and conditions at any time by posting the amended terms on this site. Terms are effective immediately upon posting. These terms and conditions may not otherwise be amended except for a special circumstance, which must be described in writing and signed by both parties. This version of the site was first posted on July 10, 2009.

In the event that CollectAPhone receives a cell phone or other personal electronic device from an individual, a non profit organization or a business, CollectAPhone will evaluate the device and send a percentage of the phone’s value to the non profit organization indicated by the donor. Once a shipping label has been printed, CollectAPhone will not change the name of the charity that will be the beneficiary of the cell phone donation. CollectAPhone must receive and process the donated cell phone before a check is issued to the beneficiary organization. Only organizations recognized by the IRS as a 501c3 organization are eligible for the CollectAPhone program.

Removing Data from Your Current Product

You agree to remove all data from your current product before shipping it. See "How do I remove data from my system?" in our Frequently Asked Questions section if you need assistance. By sending CollectAPhone your product, you agree to release it from any claim with respect to the product, the data stored in such product, and any information on any media used in conjunction with the product. CollectAPhone will not be responsible for securing, protecting, keeping secret or otherwise managing any form of data or information that is stored on or otherwise contained in any product that you send to CollectAPhone (including any SIM card or SD card). You bear sole responsibility for removing or securing such data, or for transferring it to a medium under your continuing control.

For all devices, please include the battery and battery door. No additional documentation or accessories are requested. Package the item(s) in a bubble mailer or a padded envelope. Please ensure that all products are packaged SECURELY without room to move. We recommend using bubble wrap to protect the product.

Cell Phone Service

It is the responsibility of the user to discontinue service on handsets sent to CollectAPhone before shipping cell phones to CollectAPhone. CollectAPhone is not responsible for previous or subsequent airtime charges accrued prior, during, or after any transaction. Should any airtime charges be accrued, it is the responsibility of the original user and service provider to resolve payment issues.

Reseller Involvement

Releasing Rights to the Product

Once you send CollectAPhone your product, CollecAPhone cannot honor any request for return of the product and/or any data or information contained in said product.

Fitness for Sale

You must own the right, title, and interest in any and all items sent to CollectAPhone. Such items, or the sale and shipment of such items, must not violate any applicable laws, statutes, ordinances, or regulations, including export laws. You are responsible for complying with any and all such laws.

Redistribution and Recycling of Products

CollectAPhone will be solely responsible for ensuring that this product is redistributed and/or recycled in accordance with applicable Environmental Protection Agency regulations.

Independent Contractor

Signing up for any of CollectAPhone’s programs in no way constitutes or gives rise to a legal partnership, joint venture or other relationship between the parties. Each of the enrollees in any program and CollectAPhone will operate under the terms of this Agreement as an independent contractor and not as an agent of the other.

Unless otherwise specified, materials appearing on this site, including the text, site design, logos, graphics, icons, and images, as well as the selection, assembly and arrangement thereof, are the sole property of CollectAPhone and the respective owners of this site.

THESE TERMS AND CONDITIONS ARE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH NEW YORK LAW, AND NO CONFLICT OF LAWS OR PROVISIONS OF ANY JURISDICTION WILL APPLY TO THESE TERMS AND CONDITIONS. BY SIGNING UP WITH COLLECTAPHONE OR BY PRINTING OR USING A PREPAID SHIPPING LABEL FROM COLLECTAPHONE, YOU AGREE THAT ANY ACTION AT LAW OR IN EQUITY ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS WILL BE FILED ONLY IN STATE OR FEDERAL COURT LOCATED IN NEW YORK STATE, AND YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY CONSENT AND SUBMIT TO THE EXCLUSIVE JURISDICTION OF SUCH COURTS OVER ANY SUIT, ACTION, OR PROCEEDING ARISING OUT OF THESE TERMS AND CONDITIONS.
