Introduction CollectAPhone provides an online vehicle for consumers within the United States to recycle cell phones, smartphones and PDAs and to choose a 501c3 organization to benefit financially from their action. We reserve the right to amend, cancel or alter these services at our sole discretion. Removing Data from Your Current Product You agree to remove all data from your current product before shipping it. See "How do I remove data from my system?" in our Frequently Asked Questions section if you need assistance. By sending CollectAPhone your product, you agree to release it from any claim with respect to the product, the data stored in such product, and any information on any media used in conjunction with the product. CollectAPhone will not be responsible for securing, protecting, keeping secret or otherwise managing any form of data or information that is stored on or otherwise contained in any product that you send to CollectAPhone (including any SIM card or SD card). You bear sole responsibility for removing or securing such data, or for transferring it to a medium under your continuing control. For all devices, please include the battery and battery door. No additional documentation or accessories are requested. Package the item(s) in a bubble mailer or a padded envelope. Please ensure that all products are packaged SECURELY without room to move. We recommend using bubble wrap to protect the product. Cell Phone Service It is the responsibility of the user to discontinue service on handsets sent to CollectAPhone before shipping cell phones to CollectAPhone. CollectAPhone is not responsible for previous or subsequent airtime charges accrued prior, during, or after any transaction. Should any airtime charges be accrued, it is the responsibility of the original user and service provider to resolve payment issues. Reseller Involvement Releasing Rights to the Product Once you send CollectAPhone your product, CollecAPhone cannot honor any request for return of the product and/or any data or information contained in said product. You must own the right, title, and interest in any and all items sent to CollectAPhone. Such items, or the sale and shipment of such items, must not violate any applicable laws, statutes, ordinances, or regulations, including export laws. You are responsible for complying with any and all such laws. CollectAPhone will be solely responsible for ensuring that this product is redistributed and/or recycled in accordance with applicable Environmental Protection Agency regulations. Independent Contractor Signing up for any of CollectAPhone’s programs in no way constitutes or gives rise to a legal partnership, joint venture or other relationship between the parties. Each of the enrollees in any program and CollectAPhone will operate under the terms of this Agreement as an independent contractor and not as an agent of the other.
